Katrina Halili's lawyer, Atty. Raymund Palad handed out CDs containing an alleged conversation among talent manager Lolit Solis, Dr. Hayden Kho and Dra. Vicki Belo mapping out their tactics in dealing with the Hayden Kho sex video scandal.
"Marami po 'tong laman. Makikita n'yo po dito yung grand design ng grupo. Kayo nang humusga. Eto po walang script 'to," said Atty. Raymund Palad.

Hayden Kho has admitted in Profiles with Che-che Lazaro that she was sexually molested as a child. They've shown it again tonight at TV Patrol. This must be what he meant when he said at one point in the interview, "Something happened to me when I was a child. Not even my parents know about it."
Here is the story.
"Were you abused as a child," asks Cheche.
A pause from Hayden then a reply, "Molested as a child."
"You were?" asked Cheche, "Do you still remember it?"
"Yeah."
"Is it painful ... the remembrance?"
Repeated nods by Hayden and then ... "Painful na nakakasuka."
"Were you molested by a relative?" asks Cheche. "Can you tell me how old you were at the time you were molested?"
"Seven, I think... In a truck ... by a person I don't know."
"So nung umuwi ka, you masked it?"
Nods from Hayden, "I washed ..."
"You washed yourself?"
"But washing wasn't good enough."
I'd like to believe Hayden but given the level of his "credibility" right now, it would be foolhardly to swallow his story hook, line and sinker. Maybe somebody can make a follow up interview to flesh out this story. Its veracity does not give Hayden Kho any legal or moral justification for what he has done but it will allow all of us to understand him a lot better.

Eric Johnston Chua, Dr. Mark Herbert "Bistek" Rosario and his girlfriend Princess Velasco appeared today in the preliminary investigation being conducted by the DOJ to submit their counter-affidavits to the complaint against them by actress Katrina Halili in connection with the uploading and distribution of the Hayden Kho sex videos. All of them denied any wrongdoing in connection with the charges against them saying that they were only responsible for retrieving the laptops and hard drives from the condo of Hayden Kho.
It will be recalled that all three respondents sent only their lawyers and did not appear personally in the first hearing of the case on June 19, 2009 wherein Katrina Halili faced off against Dr. Hayden Kho while Dra. Vicki Belo arrived late but came ready with her witnesses.

Actress Katrina Halili and Dr. Hayden Kho faced off earlier today at the start of the DOJ's preliminary investigation into Halili's complaint against Dr. Hayden Kho, Dra. Vicki Belo, Eric Johnston Chua, Dr. Mark Herbert "Bistek" Rosario and Princess Velasco in connection with the uploading and distribution of the Hayden Kho sex videos. Halili stared and glared repeatedly at Kho who would simply glance, shake his head then move his sight away from hers.
Halili was already subscribing to her affidavit when Kho arrived causing a commotion among the crowd present especially the ladies. When it was Kho's time to subscribe to his affidavit, the crowd got noisier causing the head of the DOJ panel to admonish the public to keep quiet.
Before the hearing was over, Kho's lawyer, Atty. Lorna Kapunan, urged the DOJ panel to issue a gag order prohibiting the parties from discussing the subject matter of the charge in public. "Can we have a ruling from this honorable court that out of respect for the DOJ that there be no incendiary public statements or press conferences. The press is not a government agency and neither is it a court. This cannot be done by trial by publicity."
Atty. Raymund Palad, lawyer of Katrina Halili, responded, "We are not saying anything about the sex videos in this case before the media. What we are doing is filing administrative cases, malpractice, DOH, which are separate matters."
It turned out, however, that the DOJ has no authority to issue a gag order but Senior State Prosecutor Emily Fe Delos Santos who headed the DOJ panel gave assurance that the hearing will be conducted by them with impartiality. She said, "Amin lang pong pagtutuunan ng pansin ay lahat ng salaysay, ebidensiya, kontra-salaysay, ebidensiya. We will not be persuaded or influenced by media."

Dra. Vicki Belo also arrived at the DOJ but it was after the preliminary investigation had already ended. She arrived minutes after Dr. Hayden Kho and Katrina Halili left the hearing venue. She came with her witnesses who subscribed to their affidavits before the DOJ panel.
Dr. Belo's witnesses are the guards who recorded in their logbook Eric Chua's presence at the Belo residence and Jacqueline Tang, the Singaporean lady advertising executive and Belo Medical Group consultant that Dr. Adel Tamano identified in a TV interview several days ago as the person with whom Dra. Belo was having a dinner meeting and who saw Eric Chua hand over to Dra. Belo the DVD recording of the Hayden Kho sex videos.
The other respondents in the case namely Eric Johnston Chua, Dr. Mark Herbert "Bistek" Rosario, and Princess Velasco did not attend the hearings but simply sent their lawyers. They are expected to attend the next hearing on June 25 when they will also submit and testify on their respective affidavits.
There will be a clarificatory hearing on July 14 after which the DOJ panel will come up with its determination if a probable cause exists that would warrant the filing of the case in court.

The way I see it, regardless of what some of us might think, unless Eric Chua is able to controvert the counter-allegations made by Dra. Belo and her witnesses which tend to belie Chua's claim that Dra. Belo had the only copy of the DVD containing the Hayden Kho sex videos extracted from the laptops, the lady doctor might get off the hook in this case.
You will recall that Eric Chua claimed he made a single master copy for Dra. Belo and gave it to the lady doctor. However, Atty. Tamano insists in his TV interview that the logbook kept by the agency security guards indicate Eric Chua as having left the Belo residence AFTER Dra. Belo left on the night in question, thus giving him about an hour and a half alone with the laptops and the sex videos, more than enough time to make a copy of the videos for himself.
But there are things that can be safely said about about Dra. Belo and the Hayden Kho sex videos.
First, Dra. Belo made possible the retrieval of the laptops which contained the sex videos from Hayden Kho's condo unit. It was she who gave the key to Hayden's condo unit to Eric Chua, Bistek Rosario and Princess Velasco so that they could retrieve the laptops.
Second, she also made it possible for Eric Chua to retrieve the sex videos from the laptops since she asked him to do it and allowed him inside her house for that purpose.
Third, assuming her version of the story is correct, she gave Eric Chua the chance to make a copy of the sex videos for himself since, according to her version, she left her house ahead of Eric Chua leaving him with more than enough time and opportunity to make more than one copy. Although Atty. Tamano insists that Dra. Belo instructed Eric Chua to delete the videos, it appeared that being present on time for her dinner meeting that night was more important to her than ensuring that the sex videos were deleted before she left her house.
Atty. Adel Tamano was interviewed by the hosts of StarTalk on June 13, Saturday.
In said interview, the lawyer of Dra. Vicki Belo explained in considerable detail why his client is innocent of the charge of uploading or distributing the Hayden Kho sex videos. Atty. Tamano labelled as untrue Eric Chua's claim in his affidavit submitted to the NBI that he left Dr. Belo's house ahead of the lady cosmetic surgeon. The fact, according to Atty. Tamano, was that Eric Chua was left alone for about an hour and a half in Dra. Belo's house with the computer and the videos on the night in question.
Atty. Tamano also disclosed that Eric Chua got the wrong date of December 18, 2008 as the date of the incident because he copied it from the affidavit of Dra. Belo which was filed ahead of everybody else at the NBI. (Ano tawag do'n? Nangodigo?!)
He said that according to the security guard's logbook, the correct date was December 12, not December 18.

Joey: Kasama natin ang legal counsel ni Dra. Vicki Belo, Atty. Adel Tamano, good afternoon.
Ricky: Good afternoon, Atty. Tamano. Adel, sa huling pag-uusap n'yo ni Dra Vicki ... How does she feel about being charged na accessory to the crime na nagawa ni Dr. Kho against Katrina Halili?
Adel: Well siguro, yung word that will best describe it is, 'Unfair.'
Unang-una dahil ... although maraming naaawa kay Katrina, 'no, nakakalimutan natin na biktima rin si Dra. Vicki Belo. That she is the one inagawan ng boyfriend ... she is the one na ... in spite of everything still supported Katrina Halili, kept her bilang endorser ng Flawless and yet, ngayon, siya pa'ng pafile-an ng kaso.
Pangalawa, unfair din dahil kung babasahin mo yung pinayl na kaso nina Katrina, wala talagang ebidensya. Kasi, hindi pwede po sa batas natin, hindi puwede yung mga haka-haka, o yung 'who do you think is the one guilty' ... that's not enough eh. Because under our system of law, kailangan may ebidensiya ka at kailangan maalala natin that ...
Si Dra. Belo, wala siyang ... the burden of proof to prove she's innocent ... hindi yun na kay Dra. Belo ... hindi niya kailangang iprove na hindi siya nag-upload ng videos. Ang dapat mag-prove na nag-upload ng video si Dra. Belo is Katrina Halili or Eric Chua.
Lolit: Pero hindi, Attorney, teka. Di ba ang isyu lang dapat, yung kung sino kumuha ng sex video? Kung sino yung gumawa non? Ba't kung saan-saan na yata napupunta yung kaso?
Adel: Well, sumasang-ayon ako do'n 'no. Talaga, the main issue really here is the taking of the sex videos. But kasi ginawa ng isyu yung pagdi-distribute nung videos and ako 'no, it's very clear, hindi ayon sa haka-haka, ayon sa ebidensiya mismo ... it is not Dra. Belo
Joey: Attorney, ito naman. May inconsistencies daw sa mga pahayag nitong si Eric, si Bistek at saka si Dra. Belo sa mga pahayag. Anong masasabi n'yo rito?
Adel: Well, sa 'kin yung inconsistencies talaga is dun sa affidavit ni Eric Chua.
Kung susuriin n'yo na mabuti, sa simula pa lang, mali na siya. Ang sabi niya ang residence ni Dra. Belo is on Tamarind Street, obviously mali yon.
Pangalawa, sabi niya, si Dra. Belo asked him to come over to her house para to help her open the computers ... and yet in the same affidavit, sinasabi niya that it was Dra. Belo who gave the password, di ba? So kung ... kung alam niya na yung password, why would she call Eric Chua?
But this is the most important one. Minsan kasi pagka gumagawa ka ng affidavit ... nakalimutan mo that there might be witnesses. 'No? Ang sabi ni Eric Chua sa affidavit niya ... were that after he downloaded the videos, nauna siyang umalis sa bahay ni Dra. Belo, hindi po tutoo 'yan.
Because ang hindi naalala ni Mr. Eric Chua, that everytime you enter Dra. Belo's house, may security guard dun. At yung security ... the security guard will record not just who you are but what time you arrived and what time you left.
So, we took a look at the logbook 'no at kinausap namin yung mga security guards. Si Eric Chua arrived at Dra. Belo's house at 5:45 nang hapon, si Dra. Belo umalis ng 7:25 and si Eric Chua left the house at 8:55. Meron pong isang oras at kalahati that it was just Eric Chua with the computer and with the videos. So dun pa lang ... dun pa lang sa affidavit ni Mr. Eric Chua, hindi na tutoo yung sinasabi niya because we have two witnesses, dalawang security guards. And documentary evidence meaning yung logbook mismo na nagpapakita na hindi tutoo yung sinasabi niya.
Butch: And they have the logbook from way back December 2008?
Adel: Yes, we have it in fact, sa affidavit po ni Dra. Belo, we have made it part ... we are submitting yung content ng logbook, yung affidavits ng mga security guards.
At ito pa! Nakalimutan ni Mr. Eric Chua. Minsan kasi basta may ginagawa kang isang bagay, nakalimutan mo na baka may witness. Actually, doon po sa restaurant, tulad ng sinabi sa affidavit ni Dra. Belo, pumunta si Eric Chua at dun niya inabot yung ... ah videos. Which was against the instructions of Dra. Belo. Dra. Belo's instructions was just to delete all the videos.
Ang problema kay Mr. Chua is may nakakita sa kaniya. We have a witness, her name is Jacqueline Tang ... she is kakaiba 'no dahil Singaporean po siya ... Singaporean national ... she's not an employee of Belo Medical Group ... she's a consultant ... at nakita po niya na inabot ni Mr. Eric Chua yung video kay Dra. Belo. So dun pa lang, on our side, meron kaming matibay na ebidensiya to show na yung mga sinasabi po ni Mr. Eric Chua, hindi tutoo. So hindi na po ito mga haka-haka, paratang, o pag-aakusa. This is hard evidence.
Butch: Pero si Dra. Belo ba sisipot dun sa DOJ as per order ng korte?
Adel: Yes. At ... well, first, hindi po order ng korte dahil this is still a proceeding sa DOJ. So, tulad ng sinabi namin from the start whether sa DOJ, sa Senate, NBI ... kahit anong imbestigasyon po ... we will cooperate, kung kailangan siyang pumunta don, pupunta siya don dahil walang pong itinatago si Dra. Vicki Belo at ang katotohanan ay inosente siya. But what the public should remember is that the burden of proof is not on Dra. Belo to prove that she's innocent. Dapat ang magpapakita ng matibay na ebidensiya ay yung mga nagpaparatang at those who are acccusing Dra. Belo.
Ricky: Atty. Adel, yung na-mention ni Quark sa VTR na nag-attempt si Eric Chua daw na ibenta sa isang istasyon yung video na hawak niya ... May bearing ba 'yon sa kaso?
Adel: May relevance yun ... may bearing yun sa kaso. Pero ako honestly, as a lawyer and someone who has ... I guess started to care about the family of Dra. Belo, I did not want the children to get involved kasi sobra na rin silang masyadong they've experienced so much psychological pain and sufffering from this, parang ayoko na silang masangkot pa o madagdag pa sa kaso.
Butch: Eto naman Lolit, lilipat tayo sa 'yo. Kasi lumabas na 'yong mahabang version ng audiotape ... I mean, nakahanda ka ba sa posibleng paglabas nung unedited tape?
Lolit: Anytime! Di ba, wala naman akong dapat katakutan! Mabuti nga para makita nila kung ano talaga ang context nung pinag-uusapan, di ba? Pero sa 'kin talaga, I can say, wala talagang kinalaman si Vicki! Kasi, may mga taong nang-iintriga sa 'kin bakit daw lalabas 'yon baka si Vicki nagpalabas. Definitely, si Vicki innocent!
Adel: If I can add to that, 'no. Even yung affidavit ni Eric Chua, nung pinapunta ng NBI si Eric Chua a couple of weeks back, hindi siya nag-attend at hindi siya nagsubmit ng affidavit. Kami, nung sinabi ng NBI, 'submit kayo ng affidavit,' nag-submit kami ahead of everyone! Why ahead of everyone?! Ahead of Dr. Kho, ahead of Eric Chua, dahil wala kaming tinatago!
Si Mr. Eric Chua only submitted his affidavit, two weeks after everyone has submitted their affidavit. Kaya ang daming ... in fact, even yung date na sinasabi niya when the incident happened, mali! Dahil kinopya niya yung date from our afffidavit. And after we looked at yung logbook ... inexplain namin sa supplemental affidavit namin na mali pala yung date na December 18. The incident pala happened December 12 ... ayon dun sa logbook
Kasi minsan, when you interview a witness like Dra. Belo, yung mga dates hindi mo na naaalala masyado eh ...
Lolit: The time ...
Adel: ... yung mga oras, ganyan ... but once you see documentary evidence ... eto this is not fabricated ha, this is the logbook of the security company, not Dra. Belo's company, the security company. Nakita namin December 12 kaya inexplain namin yun yong tunay na date.
Joey: Attorney, ano yong susunod n'yong hakbang ni Dra. Belo?
Adel: Tulad ng sinabi namin. We will cooperate with all the investigation. Nagfile na po kami ng supplemental affidavit sa NBI dahil ine-explain namin maraming butas po yung affidavit ni Eric Chua. Sa DOJ naman, we'll also file an affdidavit and really for us, at the end of the day, basta makita ng tao 'no, in fact, I will give you a copy of all the affidavits pati lahat ng ebidensiya namin ... basta makita ng tao yung ebidensiya, people will realize that Dra. Belo is the victim here at inosente po siya.
Butch: Ang pinagtaksilan!
Lolit: Hindi! Ang kasalanan lang talaga ni Vicki na-inlove siya sa ... ano ba 'yon? G*go ba tawag do'n?

Dra. Vicki Belo filed her supplemental affidavit with the NBI yesterday to contradict allegations by Eric Chua that she had the only master copy of the Hayden Kho sex videos and, therefore, the only one with the capability to distribute them. Atty. Adel Tamano says that this is not true and insists on his client's innocence. He says that that is the reason why they filed a supplemental affidavit even though the NBI has not yet asked for the same.

Kris:Why Hayden.Kasi, it’s not like he’s the most believable person right now, ha?
Eric:I’m sayingHayden got me in this mess, so he should get me out.Right?I’m only here because they named me.

Eric:You only know who your true friends are when you’re at your lowest.When everything is ok, you have a lot of people around you, right?

Kris:Just because he did some bad things does not make him a bad person. He made some mistakes but everyone makes mistakes. And then we move on and we try to be better people.

Kris:So the knowledge of these video recordings came from you guys …, you were the ones who told her?
Eric:Yeah.
Kris:And what did she say?
Eric:She said she wanted to see them.She gave us the key and told us to go there and get the computer…
Kris:Eto yung condo, ni Hayden?

Dr. Mark Herbert "Bistek" Rosario has come out in public for the first time since the Hayden Kho sex video scandal broke out. He gave an interview with Jay Ruiz in a report shown tonight on TV Patrol.
What he had to say basically has been said by Eric Chua. He said Hayden Kho was a very close friend, somebody he considered like a brother. "This was a guy that I really trusted ... siyempre I got really angry din," Bistek said when he learned about the relationship between Hayden Kho and his girlfriend, Princess Velasco. The resident doctor says he's gone on voluntary leave from the hospital where he's working as a result of his being implicated in the scandal.
But one significant aspect of his story is that, as a doctor, he checked his friend Hayden's condition when they reportedly rushed to Hayden's condominium after the latter apparently tried to commit suicide and Bistek Rosario led the group in rushing Hayden to Makati Med. Dr. Mark Herbert "Bistek" Rosario, it now appears, probably saved Hayden's life.
"Napatawad ko na siya," says Bistek of his former friend Hayden Kho.
My impression is that Dr. Mark Herbert "Bistek" Rosario's TV persona in his interview with Jay Ruiz looks very much different from their group photograph (Hayden, Bistek and Eric) which by now has been flashed countless times on TV.
Kris Aquino’s interview with Eric Chua promises to be, so far, the most thorough interview he’s going to give on the issue of Hayden Kho’s sex videos. Part 1 of theinterview began last night.
Here is the transcript of the interview (I just missed a few seconds of it in the beginning):
Kris:Ilan ang negosyo mo?
Eric:Just one.
Kris:But how many branches?
Eric:15.

Kris: How long na yung relationship ninyo?
Eric:A year and two months.
Kris:Where did you meet?
Eric:In Manila.

Eric: Yeah, party circuit.
Kris: Dun mo ba na-meet si Hayden?Dun sa party circuit na ‘yan, hindi?
Eric: Nakilala ko po si Hayden kay Bistek. Nung year 2002.
Kris:Nung 2008 nangyari yung gulo … six years mo siyang ano.
Eric: Yeah, yun.
Kris:By that … madalas kayong magtawagan? So you would say that you are a sincere friend to him?
Eric:Yes, I was very sincere.
Kris: How long has Bistek been your friend?
Eric: I met Bistek around year 1997.That’s when I entered college. … batchmates kami pero sa Xavier po ako nag high school siya sa Ateneo.
Kris:And then?
Eric : … pagkatapos nung nag-college na ‘ko sa Ateneo, ah … siya naman sa UST …
Kris: How did you get to know Dra. Vicki Belo?
Eric: Through Hayden.
Kris: Ok, so, naging maging friend mo rin siya?
Eric:No.
Kris:Ano?
Eric:More like acquaintance.

Ito po ay isang panawagan upang depensahan natin ang karangalan ng ating bansa sa pamamagitan ng pagpigil sa planong ikulong ang Monumento.
Ang blog pong ito ay inumpisahan sa layuning pagyamanin ang kulturang Pilipino, lingunin ang mayamang kasaysayan ng ating bansa at ipagtanggol ang dangal ng ating bayan sa pamamagitan ng pagpapahalaga sa mga banal na bantayog at alaala ng ating mga bayani.
Pangunahin dito ang Bonifacio Monument sa Caloocan City, lalong kilala sa tawag na Monumento, na ngayo’y humaharap sa pagkakakulong dahil sa napabalitang pisikal na pagdurugtong ng LRT at MRT3. Ang Monumento po ay napapaligiran rin ng malalaking mga billboards. Ang mga bagay pong ito ay ipinagbabawal ng guidelines ng National Historical Institute (NHI) ngunit wala po tayong naririnig mula sa NHI tungkol sa mga paglabag na ito. Maaari po tayong umunlad nang hindi natin dinudungisan ang dangal ng ating bansa at habang patuloy na pinagyayaman ang kalinangan ng ating lahi.
Layunin din po ng blog na ito na magbigay daan kahit na sa munting paraan upang makamit ang tunay at makabuluhang pagbabago sa ating mahal na bayang Pilipinas at sa buhay ng maliliit na Pilipino, lalo na yung walang mga boses at hindi alam kung paano ipagtatanggol ang kanilang sarili.
Bilang umpisa, hinihiling ko po ang tulong n’yo sa pagsusulong ng kampanya upang maibilang ang Monumento sa listahan ng UNESCO World Heritage Cultural Sites.
