"Nay, I Can't Wait to See You Again ..." — Kaye Failon

In the eulogy prior to Trina's cremation this morning, Kaye Failon perhaps verbalized best her family's unimaginable anguish at the loss of her mother, Trinidad "Trina" Etong ... "'Nay, I Can't Wait to See You Again ..."    
'Nay, mami-miss ko yung amoy ng buhok mo.
mami-miss ko yung hawak ng kamay mo.
Nay, mamimiss ko yung halik mo sa 'kin na parang wala nang bukas.
Even Ted Failon has identified Kaye as the person bearing the brunt of the burden for their family right now. Ted himself came close to admitting that he is on the verge of giving up or even possibly shooting himself. He uttered these words in  Tagalog "minsan po iniisip ko ... magbabaril ako sa ulo ko..." (sometimes I think ... I will shoot myself in the head ...). It is a classic study in utter bereavement and despair.  I can imagine it to be similar to being physically free and yet feeling as if you're all alone, imprisoned in a dark, forbidding dungeon from which there is no escape. 

With the cremation of Trina's mortal remains, a chapter closes in the Failon family saga. Unfortunately, in spite of Kaye's appeal to the public that they be given time to rest and to be alone, I don't see any rest for them any time soon given that there are at least three investigations that Ted Failon and his household face. 

The first one is the ongoing preliminary investigation into the obstruction of justice case regarding the alleged tampering with the crime scene; the second one is the ongoing investigation by the NBI into the shooting death of Trina herself which it has assumed from the PNP; and the third one is the planned investigation by the Commission on Human Rights (CHR) into the perceived excessive use of force by the QCPD.  

Emotional grief, spiritual anguish, physical exhaustion ... all of these intangible enemies are confronting the members of the Failon household by now. Depression, a deadly stalker, has obviously set in especially in the case of Ted Failon. Kaye, it appears to many, is made of sterner stuff. 

Let's continue praying for God's comforting grace to sustain Ted Failon, his daughters Kaye and Karishma and the rest of his family at this critical time.

Remembering TRINA Forever! The TRINA Benchmark of Minimum Acceptable Behavior for the Police and All Public Officials

Nothing we’ll ever say or do could ever console the Failon family. Their loss is irreplaceable. But we need not remember Trina's death simply as a tragedy forever.  It can be a story of hope and triumph, rebirth and renewal amidst the tragedy.

How do we do that? 

By remembering 
Trust  Respect Integrity Neighborliness Accountability

The police should 

Maintain the  Trust of the public in performing their duties
Observe          Respect for the rights of both victim and suspect
Keep                Integrity in their person
Show              Neighborliness especially to the grieving 
Accept            Accountability for their actions

We’ve never had such a time as this in our history.  This is our chance to impose a rigid set of minimum standards for police behavior.

I’m sure the police have their own set of standards and rules.  But do we know about them? Are they published?  Readily accessible?  Readily understandable?  Widely taught?  Innovatively presented?  Easily implementable?  Easily enforceable?    

Perhaps just as important, are these standards and rules acceptable to us?  Do we have a say in crafting them or in revising or upgrading them or recalibrating them when necessary?

A benchmark is a standard and for it to be meaningful, it should be something that we clearly understand, something measurable or perceptible, something we can check.  Something that children can study in school or by themselves so that even they will have an idea of how to gauge the performance, demeanor and behavior of police officers who are supposed to serve and protect all of us.

In the midst of the ongoing national tragedy, a number of police officers crossed a line they should not have crossed in effecting the arrests on members of the Failon household.  These police officers imposed their will on a family that was grieving and somehow managed to make themselves morally accountable for possibly hastening the death of a dying suicide victim, implementing a warrantless arrest of obstruction of justice suspects who were clearly not on the run, applying excessive use of force and displaying arrogance in the process.  They flaunted abuse of authority before national television and somehow expected to get away with it.

In the process, Malacañang itself was put on the defensive. Nakuryente (electrocuted) is what they call it.  Press Secretary Cerge Remonde’s belated admonition to police officers to respect the rights and privacy of the grieving Failon family fell flat in the face of the damage that by then, had been already done.

We are at a crossroads in Philippine history. Let’s seize the moment. That’s how we’re going to change this country. 

Filipino Christians should realize that prayer alone will not change our country.  We pray to ask God for guidance as to what to do, for strength and wisdom in doing what He tells us to do and for His Spirit’s power in bringing about what needs to be done.  That is the Biblical teaching.  The Jewish prophet Nehemiah could not have rebuilt Jerusalem’s shattered walls if he had simply prayed about it and stayed in Persia.  No!  He went to the Persian king, pleaded with the monarch to allow him to go back home and did so upon obtaining permission.

He lost no time in building an army of prayer-worker-warriors.  An army who prayed and worked while staying prepared to defend themselves in case of war.  And eventually, he succeeded in leading the rebuilding of Jerusalem's walls!  

What we need is not just to learn the lessons and then forget about them when the memory of the incident fades.  What we need is to learn the lessons, discuss and lay down a plan of action and then act on it!  By setting and laying down the TRINA Benchmark, that is what we can do!

When we next talk of Trina’s story, it should not be an unmitigated tragedy.  It should be the start of a process of renewal, the rebirth of hope. With Trina’s story, we’ll still walk away with memories of the tragedy but also with something else — the self-respect and dignity of a nation that says “Enough!” "Enough of the abuse!"  "Enough of the indifference to the abuse!" 

Perhaps to help us do that, we have a Chairperson of the Commission of Human Rights in the person of Atty. Leila de Lima who doesn't keep quiet in the face of apparent injustice.  She’s not perfect, nobody is but no one can say that she's not trying to do a good job. 

Those of us who have the time or the opportunity to do so should attend the hearings that the CHR intends to hold on this case.  Failing that, we can write or send email messages to Atty. Leila De Lima and tell her that we’re interested in change and that what she's doing contributes a lot towards bringing about that change. 

I am not singling out the police about this matter.  It's just that they are the ones who are now in the spotlight. But the TRINA benchmark is applicable to ALL public officials. Eventually, to all of us. We'll just start with the police. 

To be fair to the police, the PNP and the DILG, the decision by Secretary Ronaldo Puno to have the NBI take the lead in the Trina investigation is a step in the right direction.  By giving way, he's showing that the police leadership can exercise some humility and listen to the voice of the public that it serves. The PNP has a good website and the NAPOLCOM as well where they can post the TRINA benchmark.  

Exactly what will the TRINA benchmark be or what will it consist of?

My ideas are as follows:

1)  A booklet or series of booklets consisting of various situations using illustrations or pictures comparing the behavior of a GOOD COP with a NOT-SO-GOOD COP.  For example,

1.1 When doing traffic duties, where do traffic cops need to position themselves?  Out in the open or hiding in a dark corner ready to pounce on unsuspecting motorists?

1.2   When apprehending motorists, who should approach who?  The traffic enforcer going to the motorist or the motorist going to the traffic enforcer (with something tucked in the driver license)?  

1.3  When apprehending suspects or inviting people for questioning, should the police disregard counsel who are pleading to talk with their client or should the police respect the suspect's right to counsel?

2)  A booklet explaining in easily-understandable language the laws relevant to the police and other law-enforcement officials.  

Remember that these are just my preliminary ideas.  Nothing set in stone here.   

And this is where the public can help.  If you have your own ideas as to how to implement the TRINA Benchmark, then you can volunteer your inputs and we'll all have a happy time synthesizing all of these inputs.  Eventually, the TRINA Benchmark will be our concise guides that will serve as the conscience and deterrent to future abuses and incompetence. Tulong-tulong tayo, parang bayanihan dahil lahat tayo makikinabang dito!   

As we go about doing this, we should see qualitative improvements in the life of our nation.  All because of TRINA!  And when we remember her, the tears that will flow down our eyes will not only be tears of sadness at her untimely passing but tears of joy that her life, in spite of its sorrows, could be such a tremendous blessing for our nation.

As I post, it's 11:46am, Manila time.  The clouds have suddenly darkened and it's raining hard right here as if  heaven itself is shedding tears of joy at Trina's reunion at the bosom of our Heavenly Father. The angels are shouting and it's as if they're having a fiesta out there! Goodbye Trina, we're going to miss you. 




Mabuhay si TRINA!  Mabuhay ang PINOY!

Many Filipinos Get to See Delfin Lee For the First Time Through ABS-CBN TV Patrol Report

Hundreds of thousands if not millions of Filipinos had their first glimpse of the person first introduced to the public by DOJ Secretary Raul Gonzales simply as "Delfin Lee" in a news report by ABS-CBN.  According to Secretary Gonzales, he received a text message saying that Lee was in the Failon household at the time of the shooting and that he (Lee) helped Ted move the body of the seriously wounded Trina from their bedroom to the bathroom.

Delfin Lee is reportedly a longtime friend of Ted Failon and also of Vice President Noli De Castro.  This article by Sun Star Pampanga identifies Lee as the president and chief executive officer of Globe Asiatique Realty. Lee has denied that he was at the Failon residence at the time of the shooting.  I recall seeing Vice President Noli De Castro on TV say that he requested Lee to go to the Failon household upon learning of the incident because he could not contact Ted.  According to Lee, he reached Failon's house only in the afternoon of April 15, hours after the shooting incident happened.  He strongly denied the accusations emanating from the text message received and reported by Secretary Gonzales.

This is the picture of Lee that I took as his interview was being aired at ABS-CBN's TV Patrol.  I believe that showing this constitutes fair use of ABS-CBN's rights over their video.


Anyway, if there are objections from ABS-CBN, I'll promptly pull it down.

Trina's Cremation Pushes Through Tomorrow, April 22, Despite A Last-Minute Visit by NBI Operatives at Arlington Funeral Homes

About an hour ago, ABS-CBN showed a video of the visit by NBI operatives in the wake of Trinidad "Trina" Etong.  Ostensibly, they went there to pay their respects but it was evident they made the visit for some other purpose.  As to what precisely, Chief of the NBI special task force Arnel Dalumpines failed to specify.  The video footage just showed him saying that they were respecting what Ted Failon's lawyers told them.  It was unclear what discussion transpired between the two groups.  

My guess is that the NBI team went to Arlington to make a last-minute request to delay the cremation of Trina. 

All indications however point to an "all systems go" for Trina's cremation tomorrow morning at 11am. The cremation will be preceded by a mass to be officiated by close Failon family friend, Fr. Gerry Orbos.  Trina's ashes will not be buried yet and will kept by the Failon family.

NBI WANTS THIRD AUTOPSY ON TRINA ETONG

You will note that the first part of this post is based on an ABS-CBN video.  I just came across a gmanews.tv article posted 9:24pm entitled, NBI wants own autopsy exam on Failon's wife.

Just as I suspected, said article quoted NBI special task force chief Arnel Dalumpines as saying that "they will ask the Failon family for permission to do a third autopsy."

A third autopsy may happen or it may not.  That will be one of the questions that tomorrow will answer.  

The first autopsy was done by the PNP SOCO medico-legal team which was joined by Dr. Erwin Erfe. The second one was done very early this morning (April 21) by Dr. Rachel Fortun. 


Both Drs. Erfe and Fortun were personally commissioned by Ted Failon to do the autopsies. 

Both forensic experts gave the opinion that the most probable cause of Trina's death is a self-inflicted gunshot wound entering from the right temple and exiting the left temple.  

 



 

Trina Committed Suicide Says PAO Forensic Consultant Dr. Erwin Erfe

Dr. Erwin Erfe, a forensic expert identified closely with the Public Attorney's Office (PAO) headed by the controversial Atty. Persida Acosta, has made the conclusion that Trinidad "Trina" Etong committed suicde.   

The primary basis for Erfe's conclusion is that the contusion collar was uniformly level. According to him, "the contusion collar was very uniform" which means that "the gun used was directly perpendicular" to Trina's head.  Based on this, he pronounced that it's most likely a suicide.
Erfe obtained his medical degree from the Pamantasan ng Lungsod ng Maynila (PLM) and a is a graduate of Forensic Science and Medicine at the Virginia Institute of Forensic Science and Medicine (VIFSM) medicine graduate of the PLM.   Erfe also holds a law degree from the Manila Law College and is a professor of forensic medicine at the Ateneo Law School.  You can find his credentials here.

As expected, DOJ Secretary Raul Gonzales was quick to shoot down Erfe's conclusions. According to Gonzales, it is "not proper" for Erfe to be talking because he is not a member of the official team investigating the death of Trina Etong .

QCPD Will Turn Over Trina Suicide Investigation to NBI (With Video Update)

The Quezon City Police District (QCPD) will turn over to the NBI the investigation into the death of Trinidad "Trina" Etong, wife of ABS-CBN embattled broadcaster Ted Failon.  This is the announcement made in the ongoing press conference being conducted in Camp Crame by DILG Secretary Ronaldo Puno.  I'm watching it at ANC.

In addition, the Napolcom and the internal affairs service will also investigate the possible administrative liability of police officers involved in the controversial arrest of Trina relatives and Failon househelp. Considerable criticism has been generated by the arrests which were publicly perceived to be attended by excessive use of force.  Effective today, the police officers involved are placed on a 30-day preventive suspension.

Puno added that, as part of the moral transformation of the Philippine National Police, the Chief PNP will conduct intensified refresher courses for all investigators on police operating procedures and procedures on arrest.

"To regain and maintain the public trust in the Philippine National Police (PNP)," this, Puno emphasized repeatedly, was the reason why they are resorting to these steps.

Puno also clarified that as far as the QCPD is concerned, it has no problem with the scheduled cremation of Trina's body on Wednesday, April 22 at 11am.

With respect to the objection to Trina's cremation, I guess Secretary Raul Gonzales of the DOJ is the one person primarily standing in the way at this point (that's the subject of my immediately preceding post).

As I post, it's already 12:23pm, Manila time, and the Puno press conference is still ongoing.

Even As DOJ Objects, Trina's Remains To Be Cremated Wednesday Morning, April 22, Manila Time

The remains of Trinidad "Trina" Etong are scheduled to be cremated at 11am on April 22, Wednesday, Manila time at the Arlington Funeral Homes in Quezon City.  This is according to news reports coming from gmaNews.tv.


However, the cremation won't happen if Department of Justice (DOJ) Secretary Raul Gonzales will have his way.  In a Manila Times online article, DOJ bucks Trina cremation, Gonzales was reported to be saying that no cremation should take place until the police finishes its investigation into Trina's death. 

In the same Manila Times article, Gonzales opened a new angle in the Trina suicide regarding a tip he allegedly received through a text message from an "anonymous source" who said that Trina's body "was transferred from the bedroom to the bathroom" by Ted Failon and that a certain "Delfin Lee" assisted Failon in doing it. Gonzales however admitted that his information is "very raw" and that he has ordered the NBI to look for this "Delfin Lee" so he could shed light on the case.

Trina's Close Friends Say She Made Hints of Planned Suicide

Close female friends of the late Trinidad "Trina" Etong, wife of ABS-CBN broadcaster Ted Failon, came out into the open yesterday claiming that Trina told them of her planned suicide. Their disclosure supports an earlier admission by Kaye Failon that her mother committed suicide.

In an interview by ABS-CBN reporter Jing Castañeda aired over TV Patrol, SNN and Bandila, Joy Tan said that days before April 15, Trina had told her of her money problems, that she did not want Ted to lose her trust in her and if that happened, she no longer wanted to live. 

Joy said that Trina wanted to attend Charisma's graduation and after that, she wanted to go.  Joy added that Ted gave ("intrega") all of her earnings to Trina and took only allowances for himself. Trina who obviously mishandled the money could not handle her guilt feelings and that was what drove her to commit suicide.  

Jackie Bartolome, another close friend of Trina, confirmed Joy Tan's story.  "Kung guilty si Ted bakit ko siya pagtatakpan?  Kaibigan ko si Trina at babae rin ako!"

Let's continue to pray for the Failon family, for our government authorities that they may go about their duties with respect and concern instead of arrogance and abuse and for our nation that we may stand united not just by writing or talking but in actually doing something to fight the maladies that stalk our land.

Remember that injustice wins more often by default. Kapag walang kalaban, siyempre mananalo ang pang-aabuso at kawalanghiyaan.  Tapatan natin ito ng katwiran at pagkakaisa at mananalo rin tayo!

"The Arrests Could Have Contributed to Trina's Deterioration" - Dr. Adonis Gascon, Attending Neurosurgeon of Trinidad Etong

I was watching TV Patrol early this evening and the neurosurgeon who attended to Trinidad "Trina" Etong, wife of ABS-CBN broadcaster Ted Failon, Dr. Adonis Gascon said the arrests effected by police authorities on the sister and brother of Trina yesterday "could have contributed to the deterioration of the patient."  

This is the closest that any medical professional who was intimately involved with the medical care of then comatose patient Trina Etong has come to affirming the views previously expressed by Kaye Failon.  

Looking back at the arrests effected at the New Era General Hospital and the excessive force that attended them, one cannot but wonder why the police didn't just post their personnel in the hospital so as to avert a controversy.  Had they done that, Trinidad "Trina" Etong might still be alive.  At least that's what Kaye Failon and Dr. Gascon are possibly insinuating by their statements.  

The way things stand now, the police personnel who effected the arrest could be accountable for their role in somehow hastening the death of Trinidad "Trina" Etong.  

A condoling public that has seen and will continue to see in the next several days disturbing video footages of the arrests is slowly becoming enraged.  Malacañang has belatedly issued a statement to let the Failon family alone in their time of grief.  It looks too little and too late.  "Aanhin pa ang damo, kung patay na ang kabayo!"

What is alarming is that the police led by Superintendent Franklin Mabanag displayed their rude behavior in plain public view and on camera which they knew would be aired on national TV.  You call that plain chutzpah!  Police officers who believe they can do anything in the manner they want it done.  The Filipino nation should not let them get away with it!

"Tulungan n'yo po kami! Pinaglalaruan po nila kami!  Wala silang awa! Wala silang awa sa amin!"  These words of Kaye Failon were aired at TV Patrol and at Showbiz News Ngayon (SNN), the entertainment program hosted by Boy Abunda and Kris Aquino.

I've said it before and I'll say it again. The tragic loss of Trinidad "Trina" Etong is an irreplaceable loss in the Failon family.  Nothing will bring Trina back to life again.  But her death will have meaning if the persecution being suffered by the Failon family will be met with righteous indignation by a nation that is fed up with police corruption and brutality.  Itigil na natin 'yan.  

Kapamilya man o kapuso, puwede bang magkaisa na tayong mga Pinoy?! 

Pwede kaya nating makita sina Mr. Gabby Lopez ng ABS-CBN at Atty. Felipe Gozon ng GMA-7 na magkatabi sa isang press conference at sabay humihiling ng paggalang sa karapatan ng Failon family mula sa mga awtoridad? At paggalang na rin sa karapatang pantao ng lahat ng Pilipino! Sabihan natin itong mga abusadong pulis na involved sa kasong ito, "Kami nagpapasweldo sa inyo! Gawin ninyo nang may paggalang ang trabaho n'yo. Serbisyo at hindi abuso ang gusto naming makita mula sa inyo!"

Sa larangan ng pangunguna, mahalaga ang papel ng Channel 2 at Channel 7 dahil pinanonood sila ng 92 milyong Pilipino.  Yung sinasabi n'yong pagkakaisa ay lubha nating kailangan ngayon.  Tara na't ipakita natin sa buong mundo na sa panahon ng kagipitan, kaya nating tanggalin ang rivalry at magkaisa!  Para sa bayan! Kapamilya at Kapuso, Magiging Isa! Kaisa ng Sambayanang Pilipino sa katwiran at kaunlaran!

At kapag nagawa natin 'yan, babalik ang kapirasong katinuan sa bayang ito na sana'y pagmulan na nang tuloy-tuloy na makabuluhang pagbabago at wala tayong ibang papupurihan kundi ang Panginoon!

TRINA ETONG TESTS NEGATIVE FOR GUNPOWDER RESIDUE

Much has happened since last night's death of Trinidad "Trina" Etong, wife of ABS-CBN broadcaster Ted Failon and the emotional outburst of their daughter Kaye Failon who expressed her view over national TV that the manner by which the police conducted yesterday's arrest of the Failon household help and her aunt Pam may have hastened her mother's death.  

Trina Etong's body was brought late last night from the New Era General Hospital to the Arlington Funeral Homes in Araneta Avenue, Quezon City where it was subjected to autopsy and paraffin test.  Police now say she tested negative for gunpowder residue.  It will be recalled that the Failon family did not allow Trina to undergo paraffin testing while she was in the hospital reportedly for fear that it would worsen her medical condition. Trina's body now lies in state at the Arlington Memorial Chapel located at the ground floor of the Arlington main building.

With this development, everyone in the Failon household have tested negatively for paraffin -- Ted Failon, the victim Trina Etong and their entire household.  The mystery deepens. 

Against this backdrop, GMA 7 reported that the Failon family is considering filing a complaint before the Commission on Human Rights in view of the perceived excessive use of force that the police applied on them yesterday.  On the other hand, the Quezon City prosecutor's office is preparing the filing of obstruction of justice charges against Ted Failon, relatives of his deceased wife Trina and their household help  primarily for their alleged failure to properly report the shooting incident to the police and "disturbing" the crime scene by cleaning up the evidence in the Failon bathroom and his Pajero.

Meanwhile, National Bureau of Investigation (NBI) Special Task Force Chief Arnel Dalumpines said that his unit has also begun its own parallel investigation of the shooting incident in compliance with a directive from the Department of Justice (DOJ).

Kaye Failon Says Harsh Police Arrest Might Have Hastened Her Mother's Death (with ABS-CBN Video Update)

As I write, Korina Sanchez is interviewing Kaye Failon live at Bandila over ABS-CBN.  Kaye says explicitly that the brutal police arrests of their relatives at the New Era General Hospital may have hastened her mother's death. She lamented the fact that her mother was alone when she attempted to take her life yesterday and was deprived of the presence of her brother and sister when she passed away.

"I hope this is not designed to harass Ted Failon or other media personalities," says Atty. Leila De Lima, chairperson of the Commission on Human Rights (CHR), noting that it was ABS-CBN that took the February 17, 2009 video of the shooting incident involving suspected car thieves that was investigated by the CHR.

"Grabe 'yung ginawa nila sa 'kin," Pam, sister of Trinidad Etong, said of the way police handled the investigation regarding her part in the incident.

I do not dispute the possibility that Ted Failon and/or other members of his household might be guilty of wrongdoing in what happened to Trinidad Etong. But they should be presumed innocent until proven guilty and, even when subjected to arrest, should be accorded all the rights of an accused and should not have been subjected to the harsh treatment that was shown all over national television.  

In a democratic society which purports to respect the dignity of human beings, the abusive manner of the arrests we saw on TV should not be allowed to go uncriticized.  That is how we lose our rights without our noticing it ... little by little ... until we wake up one day to see that they're gone!  And then, magtataka tayo, kung bakit at paano nawala. We get the government that we deserve!

Ted Failon's Wife Succumbs to Cranial Injury and Multiple Organ Failure

BREAKING NEWS

Just minutes ago, Ted Failon's wife, Trinidad Etong, has passed away.  According to dzBB reports quoted by GMAnews.TV, neurosurgeon Dr. Adonis Gascon said that Etong succumbed to "penetrating cranial missile injury and then disseminated intravascular coagulation, and subsequent multi-organ failure."  Dr. Gascon placed the time of Etong's death at 8:50pm, April 16.

Let's continue praying for the repose of Trinidad Etong's soul and for comfort for Ted Failon and his family.

Tragedy struck the Ted Failon household yesterday morning as his wife, Trinidad Etong, reportedly attempted suicide and is now in critical condition at the New Era  General Hospital in Quezon City.

There are those who because of the circumstances suspect foul play.  It's too early and it's unfair to make any conclusions at this time while the police are still conducting their investigation.
