Senator Bong Revilla Promises Results in the Senate's Investigation into the Hayden Kho-Katrina Halili Sex Videos Scandal

Senator Ramon "Bong" Revilla, Jr. has promised that the Senate investigation into the Hayden Kho sex videos controversy will yield concrete results.

The Senator from Cavite whose privilege speech on May 19 triggered the series of investigations and heightened public interest in the controversy gave this definite assurance in an exclusive Startalk interview this afternoon with Ricky Lo and Lolit Solis.

Senator Revilla said that the case against Dr. Hayden Kho has been positively established and that the inquiry now needs to focus on who uploaded the sex videos and on the "big fish" drug supplier alluded to by Senator Madrigal and whom Hayden Kho refused to name during Thursday's Senate hearing for fear of his life and that of his family.

May 29, Katrina Halili Goes to PDEA But Did Not Undergo Drug Test, Hayden and Irene Kho, No-Shows

Katrina Halili went to the PDEA this morning but did not undergo any drug test. Meanwhile, Hayden Kho and his mother, Mrs. Irene Kho, to show up completely at the PDEA. They were reportedly concerned about their security. In short, none of the expected drug tests happened today.

The reason given by Atty. Mamyrlito Tan for the postponement of Katrina Halili's drug test is to give way to the filing of libel charges against Mrs. Irene Kho. I find this difficult to understand. I believe there might be some other reason why the drug test did not take place.

Earlier tonight, I saw ABS-CBN's Showbiz News Ngayon's (SNN) report wherein it was said that the PDEA will use hair samples for the drug test. If you will recall during yesterday's Senate hearing, Dr. Hayden Kho pointed out that drug testing using hair samples is far more effective because traces of drugs remain in the hair for about six (6) years. When asked if they had such drug testing capability, I remember the PDEA representative saying they did not and that hair samples would need to be sent abroad. It's now turning out that that is apparently not true.

I remember seeing last year a documentary wherein a case of poisoning in the United States was uncovered by forensic experts using tests conducted on the victim's hair samples. The tests showed traces of the toxic substance used to poison the victim. A bottle of the toxic substance used was among the items seized from the perpetrator who turned out to be the victim's spouse.

So much interest has been generated by the brewing Hayden Kho sex videos scandal that this early, it promises to be the top news story of 2009.  

Different people, to be sure, have different sets of reasons for expressing their interest. There's just so much public interest riding in this case. It is a pivotal point in our social, cultural, political and legal journey as a nation.  

Today in my Yahoo Inbox, I found this message from Magdalena Sawimpalad (magdalena_sawimpalad@yahoo.com) admonishing women to learn the lessons of the Katrina Halili aspects of the Hayden Kho sex videos scandal.

ANO ANG KASO SA ISYUNG KATRINA AT HAYDEN?

Bago ang lahat, ano kayang balita ang nais takpan ng Malacañang kaya pumutok ang isyung Katrina-Hayden video? Ang isyu ng pagbulgar ni Lt. Gandia sa P40M kuropsyon sa militar, ang isyung C5 ni Villar sa senado, ang balak na ChaCha, at iba pa.

Gayunman, magpokus tayo sa isyu.

Makakasuhan ba ng sexual harassment si Hayden Kho? Anong kaso?

Kung sakaling hindi nailabas ang mga sex video na iyon, tiyak hindi malalaman ng taumbayan iyon. Tiyak di magko-complaint si Katrina. Kaya walang kaso.

Nag-file ng complaint si Katrina dahil sa pagkakalabas ng video ng hindi niya alam. Ibig sabihin ba, hindi pa ito usapin ng sexual harassment sa kababaihan, dahil payag naman siya sa ginawa nila ni Hayden Kho ngunit sa private lamang. At foul na kay Katrina, at sa iba pang kababaihang nakaranas nito, na mailabas pa sa publiko ang kanilang mga sex acts na sa pribado'y payag sila.

Paano sa kaso ng modelong si Maricar, at sa iba pang babae?

Sa ganitong kaso, may violation ba sa batas, lalo na sa anti-sexual harassment law?

Payag ang babae sa ginawa nila, pero in private. Pero nang lumabas na in public, anong batas ang nilalabag? Privacy law?

Maaring hindi ito pasok sa REPUBLIC ACT NO. 7877 "AN ACT DECLARING SEXUAL HARASSMENT UNLAWFUL IN THE EMPLOYMENT, EDUCATION OR TRAINING ENVIRONMENT, AND FOR OTHER PURPOSES" dahil hindi naman ito lugar ng trabaho o eskwelahan, kundi sa pribadong lugar.

Maaring hindi rin ito pasok sa RESOLUTION NO. 01-0940 "ADMINISTRATIVE DISCIPLINARY RULES ON SEXUAL HARASSMENT CASES" dahil nga may relasyon at nasa pribadong lugar sila.

Gayunman, may ipinayl ngayon sa kongreso na pag-amyenda sa RA 7877, at ito ang HB 3704- Amendments to the Anti-Sexual Harassment Law.

Dapat nating gawing educational para sa mamamayan, kababaihan at kalalakihan, ang isyu ng sex video, at huwag lamang maikahon sa kung sino at kanino galing ang sex video, sino ang nag-upload sa youtube at iba pa. Dapat itong pasimulan ng mga kababaihan. Panahon nang pag-usapan sa publiko, hindi lang ang isyu ng sex video, kundi ang karapatan ng kababaihan.

Dapat ituring na bayani si Katrina Halili dahil malakas ang loob niyang ibulgar ang mga ganitong kabulukang naganap, upang hindi na ito maranasan pa ng ibang kabataan.

Ano ang dapat nating matutunan sa pangyayaring ito?

Una, dapat kapulutan ng aral ng mga kabataan ngayon ang nangyaring ito.

Ikalawa, dapat magkaroon ng edukasyon ang mga kabataan hinggil sa ganitong mga pangyayari.

Ikatlo, maitaguyod ang karapatan ng kababaihan.

Ikaapat, magmungkahi po kayo _____________.

Eric Johnston Chua Did Not Go to NBI Today, May 25, But Has Talked to Jay Ruiz of ABS-CBN — Denies Involvement in Hayden - Katrina Sex Video Upload

The man everybody seems to be looking for nowadays did not go to the NBI today, May 25, but he did talk to Jay Ruiz of ABS-CBN.    

Eric Johnston Chua denied any complicity in the uploading to the Internet and the distribution of the Hayden Kho sex videos including the one with actress Katrina Halili.  A video footage of Chua was shown at TV Patrol this evening.  

However, I looked at both kyte.tv and ABS-CBN.com just now (8:30pm) and failed to find the video posted there.

Chua's appearance and denial of complicity further deepens the mystery as to how the sex videos got uploaded to the Internet and distributed through the pirate video mass market.

GMA-7 also has a report on Eric Johnston Chua by Nelson Canlas.  Although it does not show Chua talking with a reporter (as I saw with the report by Jay Ruiz), it does contain some new information involving not only Chua but Bistek Rosario and his girlfriend.  

Towards the end of the video report, there is a statement by Eric Johnston Chua saying: "I have no participation in the uploading and attempt to sell the Hayden Kho sex videos.  All allegations relating thereto are false, and will be dealth with by my lawyers in the appropriate forum and at the proper time."

Katrina Halili's Lawyer Denies Hayden Kho's Charge That It Was Katrina Who Supplied Hayden with Drugs

Atty. Mamyrlito Tan, lawyer of Katrina Halili lawyer, denies the charge of Dr. Hayden Kho that it was she (Katrina) who brought drugs to Hayden during the time when they carried on their relationship in 2007.  "Pinabubulaanan po namin 'yung sinasabi na binigyan ni Katrina ng droga si Hayden Kho. Hindi po nagdro-droga si Katrina," said Atty. Tan in the weekend report of Saksi which aired around 1:09am, exactly 30 minutes ago.

According to Atty. Lorna Kapunan, her client Dr. Hayden Kho told her that it was Katrina Halili who gave him drugs.  

"He said that it was Katrina who was providing him during the ... the ... when they were together, it was Katrina who brought him drugs."  Those were the exact words of Atty. Kapunan.

The same report showed Atty. Adel Tamano saying that his client, Dr. Vicki Belo, girlfriend of Hayden Kho, was not responsible for the release or proliferation of the sex videos while also admitting the existence of a Hayden Kho - Vicki Belo sex video.

Another lawyer of Katrina Halili, Atty. Raymund Palad, insisted that the defense of "psychological treatment" that is being invoked by the camp of Hayden Kho is not proper in the case of violation of RA 9262 or Anti-Violence Against Women and their Children.

Im afraid, this "revelation" by the Hayden Kho camp, whether true or not, will only galvanize public opinion against him. At the very least, it is an attempt by his camp to paint him as a "total victim"  — somebody who was supposedly lured into drugs and then while supposedly under the influence of drugs, lost control of himself and took those sex videos. 

Assuming he is eventually charged with a criminal offense under RA 9262, this line of defense indicates that Dr. Hayden Kho will plead "not guilty" as he is entitled to be presumed not guilty. 

But then, what "remorse" was he speaking about during his interview with media?  What did he mean when he said, "... learn to condemn the sin and not the sinner"? Ugh!  

This would be a much better place if all lawyers in the Philippines would strive not just to win legal cases or demonstrate to the public their legal erudition but to seek justice in their hearts, obtain that justice before our courts of law and truly change society for the better.

This is the apology of Hayden Kho, Take Two — this time around he's the one speaking instead of just a prepared written statement being flashed onscreen.

Igan Arnold Clavio:  Inako ni Hayden Kho ang kasalanang nagawa at lubos na pinagsisisihan ang nangyari.  Depensa ng abogado ni Dr. Kho, lulong daw si Hayden sa droga nang panahong ginawa niya ang mga kumakalat na sex video.  Pero ang ilang Senador, hindi tanggap ang paliwanag na ito.  Saksi si Mariz Umali.

Hayden:  I deeply regret everything that has happened because of my poor judgment... Hmmm... Nagsisisi na po ako.

Mariz:    Halata ang lungkot at pagkabalisa sa mukha ni Dr. Hayden Kho nang humarap sa media.  Muli niyang iginiit nagawa lang niya ang video bilang bahagi ng pribado niyang buhay, bagay na wala siyang intensiyon na ipakita sa iba. Sa halip ang sinisisi niya ang mga taong nagkalat nito.

Hayden:  Sa dami nang nadamay, sa dami ng mga nasaktang tao dahil may nagnakaw at nagkalat ng videos... Right now, I may feel deep remorse ... you know, it's too much to ask for forgiveness right now...  Sana ... sana, someday people will learn to condemn the sin and not the sinner.

Mariz:  Pero ang biktima niyang si Katrina Halili, bingi sa pagso-sorry ni Hayden.  

Katrina: Dapat 'yon, hindi lang ganoon ... hindi, hindi lang paghingi ng tawad.  Dapat po siyang parusahan.

Mariz: Aminado ang abogado ni Dr. Kho na si Atty. Lorna Kapunan, lulong daw si Hayden nang panahong ginawa niya ang mga kumakalat na sex video.

  

Atty. Lorna Kapunan:  These all happened when ... ah ... he was a drug user.  These all happened before December when Hayden was getting his treatment. 

Mariz:  Pero hindi bumenta kay Senador Bong Revilla ang depensang ito ng kampo ni Hayden.

Senator Bong Revilla: Palusot ng magagaling na abogado, 'no ah. Sa korte na lang sila magpaliwanag. 

Mariz; Paniwala pa ni Senadora Miriam Defensor-Santiago, mahihirapan lang ang kampo ni Hayden kung gagamitin nitong depensa ang umano'y problema sa pag-iisip ng celebrity doctor.

Senator Miriam Defensor-Santiago: He has never appeared in public that he has indicated other signs of insanity so he cannot claim that overnight, he became insane.

Mariz: Ako si Mariz Umali at ako ang inyong saksi!

Hayden Kho Says, "I Apologize ..." Katrina Halili Answers, "Apology Not Accepted!"

Dr. Hayden Kho has issued this statement of apology (I pieced this together from the video clip below the statement):

... I sincerely apologize for the harm it has done to other parties. I must emphasize that there was no malice on my part, or intention to hurt anyone with these recordings.  I deplore the fact that without my knowledge and consent, these recordings were uploaded on the internet, downloaded, reproduced in optical media form, distributed, and sold to the public.  

I own up to my responsibility as a professional, and have decided to suspend my practice of medicine.  This incident has had a mental and emotional effect on my being.  At this stage, I realize I cannot expect understanding and forgiveness. I can only pray that this comes in due time.

Interviewed by GMA-7 about the sex video scandal, actress Katrina Halili who was one of the women shown with Hayden Kho in the videos, said with a mix of fury and emotion:

Parang hindi ko alam kasi sobrang nagulat po ako na nagawa niya 'yon eh ... kasi, hindi po ganu'n 'yung pagkakilala ko sa taong 'yon. Sobrang ... nagulat ako, hindi ko alam na gano'n siya ka-demonyo.

The actress also appealed to the other women who appeared in the sex videos, saying:

Sana po lumabas na din kayo ... para naman maparusahan yung mga taong nambababoy sa 'tin."

Senator Bong Revilla, in spite of the criticisms against him for grandstanding, deserves credit for leading the charge in this fight that has won the support of many of our legislators, the DOJ and NBI, the CHR and the general public.

Sana, magpakita rin si Senator Bong Revilla ng sipag sa isyu ng edukasyon (tuition free increase moratorium, halimbawa), sa pre-need industry tulad ng CAP, Legacy, Permanent Plans, Prudentialife atbp., kung saan milyon-milyong kababayan natin ang nabiktima at ngayong magpapasukan ay namumrubroblema sa pagbabayad ng tuition ... atbp, etc.

CNN Videos Showing British Anger Boiling Over at MPs Excessive, Outrageous Claims

Nothing can capture the outrage felt by the British public involving outrageous expense claims by their MPs than the video clips showing ordinary Brits expressing indignation over the still-brewing scandal.  

Here are some video clips from CNN:

The disclosures have led to the resignations of Labour MP Shahid Malik and Conservative MP Andrew Mackay. More casualties are expected as the Daily Telegraph continues publishing more of these outlandish expense claims.

 

Similar disclosures of official expense claims by public officials should be done here in the Philippines so that voters, especially now that local and presidential elections are less than a year away, would have a fair, reasonable and undeniable basis of the actuations of their elected leaders.  

CNN's reporting on this issue states one of the bottom lines: "There is only one way of clearing the air: these meetings should be held in public and with the media present." 

A week into the rumpus the Metropolitan Police Commission and the Crown Prosecution Service have announced that they will convene a panel of lawyers and policemen to see if they should mount investigations which might lead to prosecutions. But people clearly want more than a convention of potential wrist slappers. There is a difference between manipulating a cozy system and downright dishonesty. Where fraud has been perpetrated prosecutions must follow. If the law does not do better than waffle on this, if there is seen to be one standard for lawmakers and another for the rest of us, then legal institutions will fall into as much disrepute as parliament now finds itself in.

Many now want the reforms of parliament to go further than cleaning up the expenses system. Does Britain really need as many as 645 MPs at Westminster, many are asking, especially now there is a Scottish Parliament and a Welsh Assembly too?

The next crucial stage, the one we are entering now, is that of MPs having to explain themselves to their constituents on their expenses claims. There is only one way of clearing the air: these meetings should be held in public and with the media present.

Remember the revelations of Navy Lt. Senior Grade Nancy Gadian and Malacañang's refusal to create a special board of inquiry to investigate her allegations while threatening to have her "apprehended"?

We need not wait for the 2010 elections to see change in the Philippines — we can have some of it now by asking for full and public disclosures of matters affecting the public interest!  

For elected officials who spend the people's money, that's the way the Britons want it, that's the way we Pinoys should have it as well!

Jun Lozada Arrested for Perjury, Promises Not to Post Bail

ZTE-NBN broadband scandal star witness Jun Lozada is now in jail after being arrested for charges of perjury filed by defeated senatorial candidate Mike Defensor.

In a dramatic turn of events, Lozada who a year ago stunned the nation by accusing personalities closely-linked with Malacañang with kidnapping him, is now the one facing a prison term. Leaders of Philippine civil society like singer Leah Navarro and Enteng Romano of the Black and White Movement were shown on TV asking people to support Jun Lozada.

Whoever thought of this "arrest Jun Lozada" stunt is not doing PGMA a favor.  With Lozada in jail and not posting bail, the spotlight will focus on him again and civil society will now have a converging point to forge unity that was lost several months ago.

Next time you know, this government will be scrambling to get Jun Lozada out of jail because of the public outrage that his arrest will create. 

Let's pray for Jun Lozada and his family and for the truth to now finally prevail. Let's visit him in jail as soon as we can and tell him that we appreciate the sacrifices he's been willing to bear for our country and people.

God can send angels to spring Jun Lozada out of jail as he did for the Apostle Peter more than two thousand years ago.  But I guess He won't be doing that now.  I believe He wants to see a conscience-stricken, God-fearing nation rise up and say, "Enough of injustice, corruption and abuse!"

Then, Jun Lozada will have his freedom once again and this fair land will have justice and fairness restored in its midst.

Mabuhay si Jun Lozada!  Mabuhay ang Pinoy!
